other weight loss products, when TrimSpa was first introduced it
contained an ingredient called ephedra. The ephedra provided significant
weight loss, but it also provided unacceptable danger to users. The manufacturer claimed that Anna
Nicole Smith lost a great deal of weight using this product. The FDA has
since banned ephedra from the U.S. market. The manufacturer now claims that
Anna Nicole Smith lost a great deal of weight from their new ephedra-free

FDA Warns Distributors of Dietary
Supplements Promoted Online for Weight Loss
The Food and Drug Administration (FDA) has
sent warning letters to 16 dietary supplement distributors making false and
misleading claims for weight loss products promoted over the internet.
"Obesity in America is at epidemic
proportions, and we will not tolerate companies making false claims
promising easy fixes," Health and Human Services Secretary Tommy G. Thompson
said. "There is no substitute for eating well and remaining physically
active."
Many of these products claim to block
starch, carbohydrates and fat calories, while allowing consumers to lose
weight without any changes in lifestyle. For example, some of the product
labels have claimed:
- "Eat All You Want! Block the Starch
and Lose Weight!";
- "Neutralize up to 66 percent of the
starch consumed in a meal";
- "This advanced dietary-fat inhibitor
helps block the absorption of fat calories";
- "Take 3 capsules before bedtime. Watch
the fat disappear!"; and
- "Guaranteed to block the breakdown of
carbohydrates and simple sugars from being converted into fat."
"These products give unfounded hope to
people who are attempting to lose weight. False and misleading claims have
significant health consequences to individuals that may be overweight
because these products do not produce the desired results," said Acting FDA
Commissioner Lester M. Crawford, D.V.M., Ph.D. "FDA will continue to enforce
the law and pursue products that lure consumers with unsubstantiated weight
loss claims."
Although dietary supplement labeling may
include claims about the supplement's effect on the structure or function of
the human body, the law requires that "structure/function" claims must have
substantiation and be truthful and not misleading. After reviewing the
claims of the various products, FDA concluded that claims being made
regarding these products are not supported by reliable scientific evidence.
FDA is requesting a response from the firms
in writing within 15 days of receipt of the warning letters stating the
action the firms will take to correct the noted violations and to ensure
that similar violations do not occur in the future.
Today's announcement reflects FDA's
continued commitment to two of its highest priorities:
- To make available more and better
information about foods and dietary supplements to American consumers,
so they can make informed choices about the products they consume. In
announcing this initiative in December 2002, FDA reaffirmed its
commitment to protect consumers from products bearing false or
misleading claims on conventional foods and dietary supplements.
- To combat the national epidemic of
obesity. FDA's March 2004 Working Group Report on Obesity recommends
enforcement actions against weight loss products having false or
misleading claims.

TrimSpa is now facing
it's second class action lawsuit. The lawsuit alleges that the company's
TrimSpa Completely Ephedra Free does not contain the labeled appetite
suppressant and practiced false and misleading advertising. TrimSpa
is also being sued by the State of New Jersey.

"Well, yes, I admit I got sucked in too. I've watched the
Anna Nicole commercials for months and gained about 8-10 pounds in the past
year. So of course, I gave it a try and decided to pony up the $90 bucks for
THREE BOTTLES and well, I was disappointed. The directions were quite simple
and I took the recommended amount of pills two, twice a day, with lots of
water and a multivitamin and you ask? Nothing happened, it's been about a
month and while I haven't gained anything but I haven't lost an ounce. I
even cut out soda and started walking a little more. After I took my dose of
TrimSpa pills I actually felt well, hungry. I think I ate more in all
honesty."

"My husband and
I bought ordered TrimSpa with two separate orders, two separate credit
cards. We were both unable to use the product because it caused severe
abdominal pains. We returned the product and they refused to honor refunds
on what they called "multiple orders." They have given me one excuse after
another and have refused to give me an accounting on how they computed the
refund they did give, and why they won't refund for both orders, which were
under two different names, clearly two orders.
My recommendation is a wholehearted "stay away" unless you are willing to
throw away good money and don't care about the refund policy."

When I
first started using TrimSpa I started out taking just 1 tablet right before
meals, so about 3 tablets total each day. When using this method I lost
absolutely no weight and despite TrimSpa's claims, I did not notice a
decrease in my appetite. On the contrary, it seemed as though my appetite
increased. TrimSpa doesn't state how long it should take to see results,
however after 2 months of use I did not lose any weight or notice any
difference in my size or weight

by now everyone has seen the commercials for this Nutramerica TrimSpa:
glamorous Anna Nicole Smith is exiting her limo with photographers
and fans "ooohing" and "aaahing" over her new, slimmer figure. And just
who/what does she credit for her weight loss? It's the dietary supplement
TrimSpa, of course! Advertised to be completely ephedra free and
patented for a reason, this sports nutrition product seems to be
